These Terms of Use (“Terms”) form a binding agreement between you and SmashTaps (Pvt) Ltd (“SmashTaps”, “we”, “our”, “us”). By accessing or using www.smashtaps.com (the “Site”), you confirm that you have read, understood, and agreed to be bound by these Terms and by our separate Privacy Policy. If you do not accept any part of these Terms, do not use the Site.

1 Acceptance and Updates

We may change these Terms at any time. The “Effective” date above shows when the latest version took effect. Continued use of the Site after we post a revised version means you accept the changes.

2 Eligibility

You must be at least sixteen (16) years old and have legal capacity under Sri Lankan law to form a contract. If you access the Site on behalf of a company, you represent that you are authorised to bind that entity to these Terms.

3 Intellectual-Property Rights

All text, graphics, logos, icons, images, code, and other content on the Site are owned by or licensed to SmashTaps and protected by Sri Lankan and international copyright, trademark, and other laws. Except as expressly allowed below, no material may be copied, reproduced, republished, uploaded, transmitted, or distributed without our prior written consent.

4 Licence and Permitted Use

We grant you a limited, non-exclusive, non-transferable, revocable licence to access and view the Site for your personal or internal-business purposes only. You may print or download one copy of pages for reference, provided you keep all proprietary notices intact.

5 Prohibited Conduct

You agree not to:

• decompile, reverse-engineer, or attempt to obtain the Site’s source code;
• use any automated means (robots, spiders, scrapers) to access or copy the Site;
• interfere with the Site’s security or integrity;
• upload or transmit any virus, malware, or harmful code;
• impersonate any person or entity or misrepresent your affiliation with SmashTaps;
• use the Site for any unlawful, fraudulent, or defamatory purpose;
• infringe or violate our intellectual-property rights or those of any third party.

6 Third-Party Links

The Site may contain links to external websites or services. We provide these links for convenience only and do not endorse or control those sites. Your use of third-party sites is at your own risk and governed by their own terms.

7 Disclaimers

The Site and all content are provided “as is” and “as available”. We make no warranties, express or implied, regarding accuracy, completeness, fitness for a particular purpose, or non-infringement. While we strive for uninterrupted service, we do not guarantee the Site will always be available or free of errors or harmful components.

8 Limitation of Liability

To the fullest extent permitted by Sri Lankan law, SmashTaps shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages arising out of or related to your use of, or inability to use, the Site—even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising from the Site shall not exceed LKR 50,000.

9 Indemnity

You agree to indemnify, defend, and hold harmless SmashTaps and its directors, officers, employees, and agents from and against any claims, losses, liabilities, damages, costs, and expenses (including legal fees) arising out of or related to: (a) your breach of these Terms; (b) your misuse of the Site; or (c) any violation of applicable law.

10 Modifications, Suspension, Termination

We may modify, suspend, or discontinue any part of the Site at any time without notice. We may also suspend or terminate your access to the Site if we believe you have violated these Terms. Sections 3, 7, 8, 9, 11, and 12 will survive termination.

11 Governing Law and Jurisdiction

These Terms are governed by the laws of the Democratic Socialist Republic of Sri Lanka. Any dispute arising in connection with the Site or these Terms shall be subject to the exclusive jurisdiction of the courts of the Colombo District.
